Terms and conditions
These conditions of sale apply only to the current price published by L’Ecole de Surf de Bretagne (ESB-Brest). They can be changed at any time. Any order implies the client's unreserved acceptance of these general conditions.
How to order on the site
To order the products, click on the basket in each product sheet. Your choices will be automatically entered on the order form with their designation and their price. Once you have clicked on the order form, fill out the form, with your full contact details and the method of payment. You can also cancel one of the previously selected products by clicking on the "trash" pictogram opposite each product. Payment for purchases by Credit Card is made on a secure site (Stripe site). Any incident on the secure site will not engage the responsibility of ESB-Brest. The shipment of goods is carried out after validation of payment by Credit Card.
Product prices are indicated in euros. The products are subject to French VAT. Any order is invoiced under the conditions appearing on the shop on the date of registration of the order. However, prices may be changed later without notice. The products remain the property of ESB-Brest until full payment of the price.
Delivery costs are calculated based on the price of the package and the place of destination, except for mainland France (including Corsica). Any customs duties to be paid are the responsibility of the buyer.
IT and freedom
In accordance with the "Data Protection" law of January 6, 1978, the processing of personal information has been declared to the National Commission for Data Protection (CNIL). The customer has a right to access, modify, rectify and delete data concerning him. He can exercise this right by writing to firstname.lastname@example.org
All information left on the site will not be subject to any other exploitation (rental or sale of files ...) than that linked to the strict activity of ESB-Brest. (Data Protection Act No. 78-17).
Acceptance of the order
All our offers are valid while stocks last. Before the conclusion of the Internet sales contract, the customer will have read the purchase order representing in detail the entire order. The validation of this purchase order will be worth conclusion of the contract of sale by Internet.
ESB-Brest reserves the right not to register an order for any reason whatsoever, in particular due to an inventory problem, or a problem concerning the order received. If the user wishes to cancel his order, the cancellation must be made by email to the ESB-Brest (email@example.com) at the latest 24 hours after validation of the order by the customer.
Any delays do not give the buyer the right to cancel the sale, refuse the goods or claim damages. Any claim for non-compliance or missing delivery of the product must be transmitted within 48 hours of receipt of the product in its original packaging.
In accordance with the provisions of article L. 121-16 of the Consumer Code, the customer has, from delivery, a period of 7 working days to return the order for exchange or reimbursement.
The exercise of the right of withdrawal obliges the merchant to reimburse the sums paid by the buyer within 30 days (after deduction of shipping costs).
The consumer must bear the costs of returning the goods. The product must imperatively be returned in its original packaging, intact, accompanied by all possible accessories.
The delivery area for goods is mainland France (including Corsica). The estimated delivery time is 72 hours to 1 month depending on the items. ESB-Brest guarantees that the products have been the subject of all the necessary care to ensure their conformity with the description which appears on the site on the date of the order. The merchandise travels at the risk and peril of the recipient. It is up to him to check the condition of the goods at the time of receipt and to specify any reservations on the delivery note and to confirm them by registered letter with acknowledgment of receipt within three days of receipt of the goods.
The delivery address must not be a post office box. If this were the case, the order could not be taken into account.
The products are sent to the delivery address indicated in the order. In the absence of the person who can take possession of the products upon delivery, the carrier will deposit a calling card at the delivery address indicated by the customer inviting him to collect the products. Never, ESB-Brest can not be held liable for any deterioration of the products due to their late withdrawal from the carrier.
A paid invoice containing the various elements of the order will be sent with the package or by e-mail.
Any delays do not entitle the buyer to cancel the sale, refuse the goods or claim damages. In the event of a complaint, the transport costs and other costs (customs) for the return of the products to ESB-Brest are the responsibility of the buyer. The reimbursement of products only is due on condition that there are no anomalies on the products. If that were the case, ESB-Brest reserves the right not to reimburse the customer. The customer can make reservations during the delivery of the products only in the event of delivery that does not comply quantitatively with the order, or in the event that the package containing the products is badly damaged. These reservations must be made in writing to the carrier on the delivery slip during unloading. A copy of these reservations should be sent to ESB-Brest (by email) no later than 12 hours after these reservations have been made. No return of products will be accepted and we will not make any exchange If the above procedure has not been followed, and if it is thus proved that the reservations are due to the fact that the package and the products are badly damaged, ESB-Brest at his choice will establish a credit, reimburse the customer for the price paid or make a new delivery of similar products.
The products offered comply with current French legislation. The customer is solely responsible for the choice of products from delivery and their use. Never, ESB-Brest could not be held responsible for any damage arising from this fact. ESB-Brest guarantees that the products are in perfect condition when handed over to the carrier. ESB-Brest cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular, postal services and means of transport, flood or fire.
